The Appellant had been arrested and charged for the murder of Dr. Chandra Narinesingh. Mr Ramlogan SC acted for the Appellant from First Instance to the Privy Council where the issue before the Board was whether the guarantee provided by section 5(2)(c) of the Constitution whereby a person who has been arrested or detained… “(iii) of the right to be brought promptly before an appropriate judicial authority” applies at the point when a Magistrate, after a committal hearing, decides to commit a Defendant to stand trial.
